THREE STANDARDS OF REVIEW ON CONSTITUTIONALITY

합헌성 여부의 판단에 있어 연방 대법원은 오랜 기간에 걸친 판례를 통해 체계적인 판단기준을 확립하였다. 정부의 개인의 권리침해여부와 관련하여 주로 사용되나, 주간통상과 관련하여 연방정부와 주정부와의 관계에도 적용된다.

1. Mere Rationality
다음 조항과 관련된 사건들에 적용된다.
•The Dormant Commerce Clause
•The Contracts Clause regarding private contracts
•Substantive Due Process regarding non-fundamental rights: economic regulations
•Equal Protection regarding non-suspect classifications and non-fundamental rights

2. Strict Scrutiny
•Substantive due process regarding fundamental rights
•Equal protection regarding suspect classifications and fundamental rights
•Freedom of expression regarding content-based regulations
•Freedom of religion – the Exercise Clause

3. Intermediate Review
•Equal protection regarding quasi-suspect classifications
•The Contracts Clause regarding public contracts
•Freedom of expression regarding non-content-based regulations

적용판단기준에 따라 요구되는 입증책임자, 입증책임의 정도가 다르다. 소송결과와 관련해서는 단순합리성 심사기준이 적용되는 경우에 원고의 승소확률이 아주 낮은 반면, 엄격심사기준이 적용되는 경우에는 승소확률이 매우 높다. 중간심사기준이 적용되는 경우에는 그 중간이라 하겠다.
